5. Complaint procedure
Seller is obliged to deliver the purchased item without defects. In the event of a defect of purchased product or defect of the service provided by Seller by electronic means, Customer may initiate a complaint procedure.
A physical defect consists in non-compliance of the item sold with the contract. In particular, item sold is inconsistent with the contract if:
- does not have properties that this kind of thing should have due to the purpose marked in the contractor resulting from circumstancesor destination;
- does not have properties that Seller has provided to Buyer, at the presentation of a sample or design;
- it is not suitable for the purpose of which Buyer informed Seller at the conclusion of the contract, and Seller did not raise any objection as to its intended use;
- was delivered incompletely to Buyer.
Item sold has a physical defect also in the event of incorrect installation and commissioning, if these activities were carried out by Seller or a third party for which Seller is responsible, or by Buyer who followed the instructions received from Seller.
Complaints about ordered products or services can be submitted:
- by e-mail to: returns@orgonlife.eu;
- by post to: OrgonLife Europe, Ozimska 18/A9, 46-053 Falmirowice, Poland.
Customer should indicate in complaint:
- name and surname;
- data enabling the transaction to be identified (e.g. transaction identification number, User login, date of placing the order, etc.);
- the subject of the complaint, its cause and photographic documentation;
- contact details (correspondence address, e-mail address) enabling contact with Customer after considering the complaint.
If the data provided by Customer are not sufficient to consider the complaint by Seller – Seller will immediately contact with Customer to complete the missing information. The deadline for consideration of a complaint is 14 days from the date of its submission. If Customer demanded replacement of item or removal of the defect or submitted a price reduction statement specifying the amount by which the price is to be reduced, and Seller did not respond to this request within 14 days, it is considered that the request is justified.
Customer will be notified of outcome of the complaint by e-mail or by post. If physical defect was found within one year from the date of delivery of the item, it is presumed that the defect or its cause existed at the time the danger passed to Buyer. If the item sold has a defect, Customer may ask for a price reduction or withdraw from the contract, unless Seller immediately exchanges defective item for a non-defective one or removes defect. Customer may not withdraw from the contract if defect is irrelevant.
If item sold has a defect, Customer may request replacement of the item for a non-defective one or removal of defect. Seller may refuse to satisfy Customer’s request if bringing the defective item into conformity with the contract in the manner chosen by Customer is impossible or would require excessive costs in comparison with the second possible way of achieving compliance with the contract.
Customer who exercises the rights under the warranty is obliged at his own expense to deliver the defective item to the place indicated in the sales contract. Seller is liable under the warranty if a physical defect is found within two years from the date of delivery of the item to Customer.
